TERMS & CONDITIONS

MACMILLAN TRAVEL DESIGN LLC is a for profit company that works on a professional fee and supplier paid commission schedule. The cost of services are published online at macmillantravel.com and are subject to change at any time. Associated costs of supplier accommodations, airfare, transportation, etc. are billed separately and in addition to professional fees.

COMMUNICATION​

  • MacMillan Travel Design's office hours are Monday - Friday from 9:00am - 5:00pm PST. All other times by appointment only. The client acknowledges that MacMillan Travel Design does not offer 24-hour assistance.

  • MacMillan Travel Design strives to reply to emails within 24 business hours.

  • Scheduling phone calls in advance is recommended. That allows MTD to prepare any necessary research or documents before the call.

PRICING​​

  • Supplier pricing and availability is subject to change until booking payments are made and written consent is required to authorize payments on client's behalf.​

  • Quotes are applicable to the date and time they are requested. Quotes in foreign currency are subject to fluctuations in exchange rates and international credit card fees. MacMillan Travel Design is not responsible for any increases due to fuel surcharges, government imposed taxes/fees, or supplier-imposed increases.

  • When we delay planning by several weeks or even months, we are often starting back at square one with pricing and availability, and may need to assess additional costs for our services. Minor changes on itineraries (activity changes, etc.) are included in our services, unless imposed by the supplier. Please note that major changes, such as date changes, hotel or destination changes, are subject to additional charges ($50/change once the trip or itinerary are booked).

  • MacMillan Travel Design services are non-refundable.

  • A supplemental fee will be added for rush services: +$200 supplement. Booking within 60 days of departure.

  • Our third party airline partners do charge ticketing fees, when applicable. You will be made aware of any fees prior to ticketing. Airline fees are not included in the cost of services and are non-refundable.

  • Suppliers are independent providers and do not act on behalf of MacMillan Travel Design, are not servants, agents or employees of MacMillan Travel Design. Sales with suppliers are subject to their respective policies for cancellation and refunds. The client agrees to meet supplier-imposed deadlines for approval and payment.

  • MacMillan Travel Design acts solely as a booking agent for disclosed principal Suppliers and is not the source or provider of any travel service. Each Supplier is an independent entity with its own management and is not subject to the control of MacMillan Travel Design. For this reason, you may see all pricing as bundled rates and not broken out by component. Some of our partners do not provide component pricing to protect their contracts, therefore MacMillan Travel Design is not able to provide / disclose component pricing. The client agrees and understands that client may receive all pricing as a “package rate”.

EMERGENCIES​

  • On the ground and in-person supplier contacts are the recommended first point of contact for the quickest and most efficient in-travel assistance. We also ask that client makes MacMillan Travel Design aware of any issues, so we can step in on client's behalf where needed. However, emails are not monitored 24 hours so responses may be delayed.

TRAVEL PROTECTION and INSURANCE​

  • Travel protection and insurance is strongly recommended to protect your investment. Unless specifically noted, travel insurance is not included in the cost of client's itinerary.

  • Information for travel insurance will be sent to you based on trip cost and components. It is each traveler's responsibility to provide written consent opting in or out of travel insurance. MacMillan Travel Design recommends travel insurance be purchased for every itinerary within 21 days of initial payment. No insurance will be purchased without a written confirmation.

  • Client understands that should he/she elect to purchase travel insurance, the terms of the policy will dictate whether, and to what extent, coverage for any financial loss may exist under the circumstances.

  • MacMillan Travel Design recommends considering Medjet Assist, a Medical Evacuation Service that can serve you and your family's needs well beyond your travels. Medjet differs from insurance and we are able to assist you with purchasing should you be interested. You can find out more about Medjet at this link.

DOCUMENTATION

  • The client agrees to provide MacMillan Travel Design with current documentation relating to travel such as Passport, Known Traveler Identification Number, Frequent Flyer Numbers, Hotel Program Numbers, etc.

  • The client acknowledges that travel documentation appropriate for entry to the planned destination(s), such as passports, visas and inoculation certificates, remain each traveler's responsibility. It is each traveler's responsibility to ensure they have provided the full and correct spelling of all legal names as they appear on passports.

  • It is each traveler's responsibility to make certain they have the proper immunizations before travel - it is the client's responsibility to see their health provider for advice. MacMillan Travel Design will advise on required documentation but travelers who do not meet advised requirements will be denied boarding/ travel. Valid passports are required for all international destinations. If a passport is required to travel, the expiration date must be at least six (6) months following the return date of the planned travel. Each foreign country holds different views of past criminal offenses - if you have a current or past offense, please contact that country directly for entry and exit requirements. Travelers with DWI or DUI records should check whether current rules exclude admission to foreign destinations. Guests traveling with a minor who are not the legal parents or guardian, or single parents traveling with a minor, are recommended to obtain a letter of consent from the non-traveling parent. MacMillan Travel Design feels it is an invasion of privacy to make such an inquiry and these requirements remain the traveler's responsibility. AIRLINE SEATING, BAGGAGE, CHECK-IN and DEPARTURE RESPONSIBILITIES

  • It is strongly recommended that clients check-in a minimum of 2 hours prior to scheduled departure for domestic flights and 3 hours prior to scheduled departure for international flights. Recommended check-in times are subject to change without notification. it is the traveler's responsibility to remain abreast of changes, in condition or airport rules that might require earlier arrival times. It is the traveler's responsibility to reconfirm flight times at least 24-72 hours prior to scheduled flights.

  • MacMillan Travel Design will not assume responsibility for any air or schedule changes. Certain countries require departure taxes that require payment in cash.

  • MacMillan Travel Design is not responsible for circumstances surrounding lost baggage or situations where bags are not able to be checked all the way through on the airline. Please consult airline websites for baggage fees and restrictions. MacMillan Travel Design is not responsible for airline baggage fees or restrictions. Some airlines charge additional fees for pre-assigned seating, and some discounted airline fares allow seat selection only at check-in. Please consult the airline website for seating fees and restrictions. MacMillan Travel Design is not responsible for seating fees and restrictions.

  • MacMillan Travel Design will not change your requested seat assignment on commercial aircraft without permission. However, airlines often change seat assignments for a number of different reasons. MacMillan Travel Design is not notified of these changes in advance, and often clients are not made aware of the changes until they arrive at the airport. MacMillan Travel Design cannot be held responsible for seat assignment changes made by the airline.

  • Frequent flyer programs are private agreements between airlines and passengers. MacMillan Travel Design cannot be held responsible for mileage discrepancies involving airline/loyalty reward programs. MacMillan Travel Design cannot be held responsible for airfare penalties due to unused legs by the traveler (for example, the booking of a round trip ticket and only using one leg, which can result in airline repricing at a higher fare).

ADDITIONAL DISCLOSURE​

  • MacMillan Travel Design is not the source or supplier of the travel services requested and acts solely as a booking agent for disclosed principal supplier cruise lines, hotels, airlines, ground transportation, and other companies providing accommodations, transportations, and/or other services. Each of these suppliers is an independent entity with its own management and is not subject to the control of MacMillan Travel Design. MacMillan Travel Design shall not be liable for any accident, injury, property damage or personal loss to client or to those traveling with client, in connection with any travel services we have booked; including but not limited to acts of God, weather conditions, natural disasters, acts of governments or other authorities, wars, civil disturbances, riots, strikes, epidemics, acts of terrorism, breakdown in equipment, theft, delay, fuel increases or cancellation or change in itinerary or schedules. MacMillan Travel Design is not responsible for and cannot amend, cancel, or communicate with any suppliers for services booked outside of our agency. It is the traveler's responsibility to communicate their outside travel bookings so that MTD can advise on the logistics. MacMillan Travel Design cannot be held responsible for Travel Warnings and Advisories issued by the government, CDC, or other authorities. We recommend using travel.state.gov as the most up to date resource.

  • MacMillan Travel Design recommends its clients pay for all travel plans by credit card, when possible. Credit Card companies provide a form of consumer protection against the loss of funds due to possible supplier bankruptcy or financial default.

  • Client acknowledges and accepts there are cancellation policies, change fees and penalties that apply to travel plans and services as set by travel suppliers. If for any reason client's credit card charges are later declined, reversed or MacMillan Travel Design is unable to receive payment for the travel plans and services, client acknowledges that this is a binding contract and MacMillan Travel Design will be entitled to recovery, including reasonable attorneys' fees in connection with collection.

COVID-19 NOTICE

  • Your destination(s) may have pre-travel testing requirements for entry due to COVID-19. The client is responsible for obtaining the appropriate documentation/testing for entry for all travelers within the party. Many tourism boards & hotel properties provide this information on their websites. The situation with COVID-19 is a fluid situation where requirements are changing constantly and the client is responsible for ensuring they are compliant at the time of travel.

  • If testing is required, please note that many destinations do not allow home tests or antigen tests. MacMillan Travel Design encourages travelers to verify that all testing is within the appropriate time period of departure and that they have received the correct form of testing for the destination(s).

  • The choice to travel is a personal decision and all travelers are responsible for following all government guidelines/restrictions, airline, and vendor protocols. As the worldwide COVID-19 pandemic remains ongoing at this time, client acknowledges that for this reason, and other reasons not reasonably foreseeable at this time, travel plans may be interrupted or cancelled by the supplier that is providing them, a government entity, or third party over which MacMillan Travel Design has no control.

  • Client acknowledges that MacMillan Travel Design is acting as an advisor and travel designer and therefore the supplier's own cancellation, rebooking, and refund policies, subject to any applicable law that is now or later may be in effect, will govern client's rights and remedies, including client's right to receive a refund, in such an event. 

  • MacMillan Travel Design, it's host agency, and consortia does not claim liability for any losses due to a lack of COVID-19 pre-travel compliance or cancellations due to closures. Client agrees to hold MacMillan Travel Design harmless and release it from all liability for any damages, including but not limited to monetary losses incurred because of such interruption or cancellation of travel plans.
